1.- GENERAL PROVISIONS

1.1. The terms and conditions set out below govern the access and use of this Website www.bahia-principe.com (hereinafter Website), which is operated and through which VIAJES GTI GRUPO TURÍSTICO INTERNACIONAL S.A. (hereinafter Viajes GTI), with CIF A30350714 and registered office at Plaza Mediterráneo, 5 07014 Palma de Mallorca (Balearic Islands), provides information society services. Registered in the Palma de Mallorca commercial registry, volume 2410, folio 67, sheet PM-65088.

1.2. The term “Website” includes, descriptively but not exhaustively, the data, texts, graphics, images, animations, musical creations, videos, sounds, drawings, photographs, trademarks, trade names, domain names and others included therein, and, in general, all creations, original or otherwise, expressed by any means or medium, tangible or intangible, whether or not they are eligible for protection under current Intellectual Property Law or any other industrial property law.

1.3. Access to the Website implies that the User acquires a series of rights and obligations in order to ensure the proper enjoyment of the services and content contained therein and which Viajes GTI makes available to the User free of charge.

1.4. The User is aware that access to and use of the services and content of the Website is carried out under their sole and exclusive responsibility.

1.5. The status of “User” is acquired by accessing the Website. The User shall use the services and content exclusively for personal purposes and/or due to their legal relationship with VIAJES GTI, excluding any subsequent use of such services for profit or for obtaining any benefit, direct or indirect.

1.6. VIAJES GTI informs the User of the following general terms of use, which are expressly and fully accepted by the User simply by accessing the Website and/or viewing the content or using the services contained on the Website.

If these general conditions are replaced in whole or in part by others, such new general conditions shall be understood to be accepted in the same manner. However, the Website User should periodically access these general conditions to be aware of the successive versions included here, although it is recommended that the User access them each time they intend to access or use the services and content of the Website.

If the User does not accept these general conditions or the specific conditions governing the use of a specific service and/or content intended for Website Users and determined by VIAJES GTI, the User must refrain from accessing the Website and/or using the services made available to them.

1.7. VIAJES GTI may establish any specific conditions regulating the use and/or contracting of specific services offered to Users through the Website. Likewise, through the Website, VIAJES GTI may enable third parties to advertise or provide their services. In these cases, VIAJES GTI shall not be responsible for establishing the general and specific conditions to be taken into account in the use, provision or contracting of these services by third parties and, therefore, cannot be considered responsible for them.

1.8. The User must implement the appropriate technical security measures to prevent unwanted actions on their information system, files, and computer equipment used to access the Internet and, in particular, the Website, being aware that the Internet is not completely secure.

2.- PURPOSE OF THE WEBSITE

2.1. VIAJES GTI is a commercial company which, through this Website, markets various hotel services offering free information about its tourism products and services under the Bahia Principe Hotels & Resorts brand.

2.2. In general, the services and content offered through the Website will be available in Spanish, without prejudice to the possibility—at the discretion of VIAJES GTI—of offering them in the remaining official regional languages, as well as in any other language spoken in the European Union.

2.4. VIAJES GTI may unilaterally and without prior notice modify the provision, configuration, content and services of the Website, as well as its terms of use and access to the provided services, without prejudice to the provisions of the specific conditions governing the use of particular services and/or content.

The cost of telephone access or any other expenses for connecting to the Website, if any, shall be borne exclusively by the User.

3.- RIGHTS AND OBLIGATIONS OF VIAJES GTI

3.2. VIAJES GTI shall not be liable for damages of any kind caused by the services provided by third parties through this page, and in particular, by way of example: (I) breach of the law, morality or public order; (II) the inclusion of viruses or any other computer code, file or program that may damage, interrupt or impede the normal functioning of any software, hardware or telecommunications equipment; (III) infringement of intellectual and industrial property rights, trade secrets, contractual commitments of any kind; (IV) actions that constitute unlawful, misleading or unfair advertising and, in general, actions constituting unfair competition; (V) the lack of truthfulness, accuracy, quality, relevance and/or timeliness of the content transmitted, disseminated, stored, received, obtained, made available or accessible; (VI) infringement of rights to honor, personal and family privacy and personal image, or, in general, any third-party rights; (VII) unsuitability for any purpose and the frustration of expectations generated, or defects that may arise in the relationship with third parties; and (VIII) the breach, delay, defective performance or termination for any reason of obligations contracted by third parties and agreements made with third parties.

4.- INTELLECTUAL AND INDUSTRIAL PROPERTY

4.2. The trademarks, trade names or distinctive signs appearing on the Website have been duly licensed to VIAJES GTI. VIAJES GTI or, where applicable, third-party entities, are protected by current industrial property laws.

4.3. Providing services and publishing content through the Website shall in no case imply the assignment, waiver or transfer, in whole or in part, of ownership of the corresponding intellectual and industrial property rights by VIAJES GTI and/or their legitimate third-party owners.

4.4. Under no circumstances may the User make use of the services and content on the Website that is not strictly personal, except for the exceptions determined in these general conditions of use of the Website or the specific conditions established by VIAJES GTI to regulate the use of particular services and/or content offered through the Website.

4.5. No part of this Website may be reproduced, distributed, transmitted, copied, publicly communicated, transformed, in whole or in part, by any manual, electronic or mechanical system or method (including photocopying, recording or any information storage and retrieval system) through any medium currently known or invented in the future, without the consent of VIAJES GTI. The use, in any form, of all or part of the content of the Website is subject to the requirement to request prior authorization from VIAJES GTI and/or legitimate third-party rights holders and acceptance of the corresponding license, where applicable, except for what is provided regarding the rights recognized and granted to the User in these general conditions or those determined in the specific conditions that VIAJES GTI may establish for regulating the use of a particular service and/or content offered through the Website.

5.- COOKIES

VIAJES GTI may use cookies when a User browses the sites and pages of the Website. Such cookies will be used by VIAJES GTI under the conditions and for the purposes described in its Cookies Policy.

6.- DURATION

6.2. The fact that VIAJES GTI does not demand compliance with any of the conditions set out in these general conditions or, where appropriate, the specific conditions governing the use of a particular service and/or content intended for Website Users, at a given time, cannot be interpreted by the User as a waiver of their right to enforce compliance at a later time.

These general conditions are governed by Spanish law.

7.- ARBITRATION

VIAJES GTI expressly states its refusal to submit to transport arbitration courts for any matter arising from the existence of this contract. 8.- JURISDICTION

The parties, expressly and unequivocally waiving their own jurisdiction, submit to the Courts and Tribunals of Palma de Mallorca (Capital) for the resolution of any disputes or controversies that may arise from the use, services and/or products contained on this website.

When the User's residence is located within a European Union member state, Bahia Principe & Resorts and the User agree to submit to the Jurisdiction of the Courts and Tribunals of the User's domicile to resolve any matters or actions arising from the provision of the Portal, its services and content, as well as from the interpretation, application, fulfillment or breach of what is established herein.

9.- PRIVACY AND PROCESSING OF PERSONAL DATA

10. CONTRACTING CONDITIONS

The website www.bahia-principe.com as well as the derived services are marketed through the company VIAJES GTI GRUPO TURÍSTICO INTERNACIONAL, S.A. (hereinafter VIAJES GTI).

10.1. The user declares that they are of legal age (i.e., at least 18 years old) and possess the necessary legal capacity to contract the products and services offered on the VIAJES GTI website in accordance with these general conditions, which they fully understand. In the event of contracting by a minor, VIAJES GTI shall not, under any circumstances, be held responsible, and the minor or their parents or guardians must assume any expenses that may arise.

10.2. All information provided by the user to access and use this website is true, accurate and complete. They are obligated to keep it updated with VIAJES GTI.

10.3. The user agrees that the data provided are correct, particularly credit or debit card details, confirming that they are the legitimate holder of the card and authorize charges for the purchased services by the entities indicated below.

Services purchased will appear on the statement as BAHIA PRINCIPE + Hotel Name (for Caribbean hotels, the hotel name will be limited to 7 characters), without prejudice to the fact that the companies billing the service are the following:

• Dominican Republic and Jamaica Hotels: Sales and Payment will be carried out by Kippin, S.A. Lussenburgo Bioggio Branch, Via Campagna, 30 Bioggio TICINO, (SWITZERLAND, VAT NUM CHE110607262.

• Mexico Hotels: Representaciones Turísticas México, S.A. de C.V. Cr Chetumal-Benito Juarez, km 250, local a, 77760 Solidaridad, Quintana Roo (Mexico), VAT NUM RTM-9705183M4.

10.4. Some countries require travelers to pay certain entry or exit fees per person.

10.5. The website www.bahia-principe.com is solely and exclusively for personal use. Modification, reproduction, duplication, copying, distribution, sale, resale and other forms of exploitation for commercial or non-commercial purposes are prohibited.

10.6. VIAJES GTI reserves the right to make changes at any time to our website and these general conditions.

10.7. Please ensure that you have read and understood the clauses and product information; it is your responsibility to make sure you have done so.

10.8. A price review may be applied due to changes in transportation rates or fluctuations in the exchange rate of foreign currency products or services offered on the VIAJES GTI website.

10.9. Tickets issued, whenever permitted by the airline, will be issued as “electronic tickets”.

10.10. Any dispute arising from the interpretation or execution of these conditions, as well as the relationship between the user and VIAJES GTI, shall be interpreted under Spanish law. To resolve any

discrepancy arising from the interpretation of these general conditions or the relationship between the user and VIAJES GTI, the parties expressly waive any jurisdiction that may correspond to them and submit to the jurisdiction of the courts of Palma de Mallorca.

10.11. The child rate applies from 2 to 12 years old, based on the age the child will have on the date of hotel arrival.

11. PRODUCTS

The VIAJES GTI website offers hotel reservation services. If the customer wishes, they may also request the flight service attached to the hotel service.

11.1. Hotel

Reservation lead time: 3 business days

Persons not included in the reservation must pay the local rate upon arrival to be added to the reservation.

Cancellation: All cancellations must be processed by contacting our customer service at 900 052 602 (ESP) +34 871 620 443 (INT) or via email at reservations@bahia-principe.com

Reservations that include 10 or more rooms or 20 or more adults are considered group reservations. For such bookings, please contact groups1@bahia-principe.com

Cancellation fees

a. Flexible Rate:

No fees if canceled 3 days or more before the hotel arrival date.

If canceled 2 days before arrival, fees will equal one night (based on the confirmed reservation).

If canceled on the same day of arrival or in the case of a “no show”, a fee equivalent to two nights will be charged (based on the confirmed reservation).

b. “Non Refundable” Rate:

Cancellation, modification or no-show will result in 100% charge of the reservation amount.

The relationship established when booking the flight service is contractual directly between the airline and the final customer. VIAJES GTI makes the reservation at the client’s request to provide this service. The hotel service cannot be canceled while keeping the flight service. Any incident related to transportation (schedule changes, flight delays, lost luggage…) is the sole responsibility of the airline.

The advance booking window to book through the website is 3 business days before travel. Reservations with 1 day advance can be made by calling our customer service at 900 052 602 (ESP) +34 871 620 443 (INT).

11.2. Flights

Flight tickets are issued as electronic tickets whenever permitted.

The airfares we offer are restricted fares subject to specific terms and conditions regarding issuance, changes, cancellations, and refunds established by each airline. For any questions, contact our customer service at 900 052 602 (ESP) +34 871 620 443 (INT)

Flight cancellation may result in total loss of ticket value. If unsure, consult our customer service at the number above.

Passports, visas and documentation

All users, without exception (including children), must carry valid personal and family documentation, whether passport or ID card, according to the laws of the destination country or countries. Some destinations require passports to have a minimum validity of 6 months. It is recommended to check with authorities regarding travel requirements. Being a baby or a child does not exempt from carrying documentation. Users are responsible for obtaining visas, passports, vaccination certificates, etc., when required. If any authority denies visa issuance due to personal circumstances, or denies entry due to missing requirements, or incomplete documentation, VIAJES GTI declines all responsibility, and the traveler must bear all expenses, applying the guidelines established for voluntary withdrawal of services.

Users, especially those with non-Spanish nationality, must ensure before traveling that they comply with all visa regulations for entry into all planned destinations.

Minors under 18 must carry written authorization signed by their parents or guardians if not traveling with them, as it may be requested by authorities.

11.3. Excursions and Transfers

Please note that the service is not provided by Viajes GTI, which only connects you with the provider. Review the provider’s terms of service before booking.

11.4. Daypass

Upon arrival at the hotel, at check-in, you must present your ID or passport for foreign guests. Payment will be made by bank card at check-in. Check-in and check-out times are recommended to be reviewed on each hotel’s fact sheet, as they may vary and are available on the website.

Only the services listed in the daypass description are included.

Cancellation fees:

No fees if canceled 3 or more days prior to hotel arrival.

If canceled on the same day of arrival or in case of “no show”, the hotel will charge a penalty to the provided card.

12. PAYMENT METHODS 

The system provides different payment methods depending on the booking date relative to the departure date and the contracted product. The Flight + Hotel product has different payment conditions than the rest. Requesting a reservation implies the customer’s commitment to pay for it using the established payment methods described below. If at the time of booking there are unconfirmed services (RQ) and only full payment by card is available, and the requested services cannot be confirmed, a full refund will be issued. Accepted payment methods: bank transfer, PayPal, and credit card. Accepted cards: VISA, MASTERCARD, and MAESTRO.

12.1. Payments

a. Flight + Hotel

The full flight amount will be charged to your credit card. The remaining amount, if permitted by the date, may be paid up to 15 days before the hotel arrival date via credit card or bank transfer.

b. Other products

Full payment by credit card.

Remember that at the hotel it is essential to present the card used for payment, as well as the passport. The hotel reserves the right of admission.

At check-in, for reservations with a regime other than all-inclusive, a credit card will be required, and an amount may be charged as a security deposit.

Requesting a reservation implies the customer’s authorization for the card charge. The full amount will be charged. If full payment cannot be processed, 40% will be charged as a deposit, and the customer will be contacted to settle the remaining 60%.

c. Full payment by transfer (valid if more than 15 days before departure or hotel arrival).

We will hold your reservation with confirmed services for two business days, allowing time to make the transfer to the account requested by calling 900 052 602 (ESP), +34 871 620 443 (INT) or emailing reservations@bahia-principe.com, indicating the reservation number in the transfer reference (found in the confirmation email). Once the transfer has been made, send proof to reservations@bahia-principe.com

d. 20% deposit payment by credit card (valid if more than 30 days before departure or hotel arrival).

20% of the reservation amount will be charged. The remaining amount must be paid 15 days before departure or hotel arrival via transfer (account information provided by calling 900 052 602 / +34 871 620 443) or by credit card contacting our customer service.

e. 20% deposit payment by transfer (valid if more than 30 days before departure or hotel arrival).

We will hold your reservation for two business days for you to transfer the 20% deposit. The remaining amount must be paid 15 days before departure or hotel arrival via transfer or card, following the instructions above.

If payment cannot be processed on the card, the customer may switch to another payment method as long as it matches one of the available options. If none are possible due to time constraints, the customer must call 900 052 602 (ESP), +34 871 620 443 (INT) to manage the reservation and explore other options.

12.2. Payments, credit card and tokenization

To complete certain reservations, depending on the selected rate or regime, a valid credit or debit card will be requested as a guarantee and, where applicable, as a payment method for all reservations, except prepayments made by bank transfer (Groups).

The card data provided by the customer will be processed securely through a tokenization system, meaning that the full card details are not stored by the website operator nor by the billing entities. They are used only through the secure payment gateway, which complies with PCI-DSS standards for card data protection.

By accepting these General Conditions, the customer expressly authorizes charges to be made to the card provided, including but not limited to the following examples, in accordance with the specific reservation conditions:

– Full or partial charge of the reservation amount.

– Second payment installment for flexible rates.

– Application of cancellation or no-show penalties.

– Charges for additional services, extras, or on-site consumption billed to the room.

– Compensation for damages caused to hotel facilities.

Charges will be made by the company operating the reserved hotel and will appear in the customer’s bank statement under “BAHIA PRINCIPE” followed by the hotel name, subject to technical limitations of banking systems.

Personal data processing will be carried out in accordance with current data protection and payment service regulations. For more information, the customer may consult the Privacy Policy available on the website.

13. CONDITIONS APPLICABLE TO PACKAGE TRAVEL

These general conditions are subject to the provisions of the consolidated text of the General Law for the Defense of Consumers and Users, approved by Royal Legislative Decree 1/2007 of November 16, and Law 7/1998 of April 13 on general contracting conditions.

13.1. Contract modifications before the start of the package trip

The traveler may transfer the package travel contract to a person who meets all applicable conditions. The transfer must be communicated to VIAJES GTI, in durable format, with reasonable notice of at least seven calendar days before the start of the trip. Both the transferor and the transferee are jointly liable for payment of the outstanding amount, as well as any commission, surcharge, or additional costs arising from the transfer. The organizer or retailer will inform the transferor of the effective transfer costs.

The price of the package trip has been calculated based on exchange rates, transport fares, fuel costs, and applicable taxes as of the program’s publication.

Any increase in these elements may result in revision of the final travel price. Price increases may only 

be applied up to 20 days before the start of the trip, and must be clearly communicated to the traveler with justification.

If the price increase exceeds 8% of the total package cost, the traveler may accept the change or cancel the contract without penalty within 48 hours. If no decision is communicated, it is understood that the traveler opts to cancel without penalty. In such cases, VIAJES GTI will refund all payments made within 14 calendar days.

Before confirmation, VIAJES GTI may modify prices, itineraries, or services included in the program due to variations in costs or unforeseen situations.

When such causes arise, before confirmation, the traveler may withdraw without penalty or accept the new price. Confirmation usually occurs within these approximate timeframes:

- 2 business days in Spain

- 4 business days in the Caribbean.

13.2. Termination of the package travel contract

At any time before the start of the package trip, the traveler may terminate the contract but must compensate VIAJES GTI for the following:

13.3. Cancellation fees, if applicable:

If any contracted and canceled services were subject to special financial conditions (aircraft charter, cruises, special fares, hotels during local fairs, show tickets, etc.), corresponding cancellation fees will apply.

- Optional insurance: non-refundable from the moment of purchase.

13.4. Fees based on advance notice

- 5% of total trip if canceled more than 10 days and less than 15 days before departure;

- 15% if canceled more than 2 days and less than 11 days;

- 25% if canceled within the 2 days before departure.

Cancellation on the day of departure or no-show results in 100% charge.

NOTE: all periods refer to business days in the departure location.

If the traveler leaves before the contracted date or voluntarily does not use any service, VIAJES GTI will not refund any amount.

VIAJES GTI may cancel the contract and refund all payments without additional compensation if:

a) The number of travelers is below the minimum required and the cancellation is notified as follows:

1.º 20 days before start (trips > 6 days),

2.º 7 days before start (trips 2–6 days),

3.º 48 hours before start (trips < 2 days), or

b) VIAJES GTI is unable to execute the contract due to extraordinary and unavoidable circumstances, notifying travelers without delay.

13.5. Execution of the package trip

VIAJES GTI commits to providing all contracted services with the agreed conditions.

If, before the start, VIAJES GTI must modify essential characteristics, cannot meet special requirements, or must increase price above 8%, the traveler may cancel without penalty or accept changes. Travelers must communicate their decision within 3 days of notification. Otherwise, cancellation without penalty applies.

If transfers or similar services are not fulfilled due to reasons beyond control, VIAJES GTI will reimburse only the alternative transport cost upon proof.

Travelers must report non-conformities immediately to VIAJES GTI’s representative (destination contact provided in documentation) or as soon as possible in writing.

13.6. Standard information form

The travel service combination offered is a package under the General Law for Consumers and Users (Royal Legislative Decree 1/2007).

You are entitled to EU package travel rights. VIAJES GTI is responsible for proper execution and is covered by insolvency protection guaranteeing refunds and repatriation if necessary.

Main rights include:

a) Travelers will receive essential information before contracting.

b) A business entity will always be responsible for service execution.

c) Emergency contact details will be provided.

d) Travelers may transfer the package to another person.

e) Price increases permitted only under strict conditions; >8% allows cancellation.

f) Major changes allow travelers to cancel without penalty and receive refunds.

g) Exceptional circumstances permit penalty-free cancellation.

h) Travelers may cancel at any time with appropriate penalty.

i) Alternative arrangements must be offered for significant deficiencies.

j) Travelers are entitled to price reduction and/or compensation.

k) Assistance must be provided if travelers face difficulties.

l) Insolvency protection: refunds and, where applicable, repatriation guaranteed. VIAJES GTI holds insolvency protection bond BANKIA S.A nº 23.476.714/71. If services are denied due to insolvency, travelers may contact this entity or the competent authority.

14. CONDITIONS APPLICABLE TO THE “CHOOSE YOUR ROOM” SERVICE

• Valid when booking a stay with VIAJES GTI through bahia-principe.com, the Bahia Principe Hotels App, or our Contact Center.

• The “Choose Your Room” service is subject to availability at all times. VIAJES GTI may modify, without prior notice, the hotels or room categories where the service is available.

• VIAJES GTI may modify the price of the “Choose Your Room” service without prior notice.

• Payment will be made in local currency upon arrival at the hotel, payable by credit card, debit card, or cash.

• The service is available until 3 days before the start of the stay.

• Once requested, the hotel team will manage the request. The hotel may accept, reject, or cancel it.

• If accepted, the customer will receive confirmation with the cost.

• If rejected, the hotel will offer an alternative that the customer may accept or refuse. If declined, the room selection process may restart.

• In case of cancellation, the customer will be informed by email.

• Allocation of the selected room is subject to availability; if not possible, the hotel will offer a similar room whenever possible. VIAJES GTI does not guarantee that the request can always be fulfilled.
